These Terms of Service (the "Terms") form a legally binding agreement between you and exerinity (exerinity.com), the individual who builds and runs Stigmi ("exerinity", "I", "me", or "my"). Stigmi is a small, independent project made and operated by me; it is not a company. These Terms govern your access to and use of the Stigmi website and any related features, tools, and content (collectively, the "Service"). Please read them carefully before using the Service.
By creating an account, accessing, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with the Stigmi Rules and Privacy Policy, each of which is incorporated into these Terms by reference. If you do not agree to these Terms, you must not access or use the Service.
Your use of the Service is expressly conditioned on your acceptance of and compliance with these Terms. By checking any box indicating your agreement, or by accessing or using any part of the Service, you agree to these Terms on behalf of yourself and any entity you represent. If you are entering into these Terms on behalf of an organization, you represent that you have authority to bind that organization.
You must be at least 16 years of age, or the minimum age required to consent to the processing of personal data in your jurisdiction, whichever is higher, to use the Service. A lower minimum age in your jurisdiction does not override Stigmi's minimum age requirement. By using the Service, you represent and warrant that you meet this requirement, that you have the legal capacity to enter into these Terms, and that you are not barred from using the Service under the laws of any applicable jurisdiction. If Stigmi learns that a user does not meet the minimum age requirement, Stigmi may terminate that account.
"Content" means any text, images, GIFs, links, audio, video, or other material submitted, posted, or transmitted through the Service. "User Content" means Content that you or other users provide. A "Stig" is a short message posted to the Service. "Account" means the credentials and profile associated with your use of the Service.
To use most features of the Service you must create an Account. You agree to provide accurate information and to keep your credentials confidential. Because the Service does not require an email address and does not offer password recovery, you are solely responsible for retaining your password; if you lose it, your Account and its Content may be permanently inaccessible. You are responsible for all activity that occurs under your Account, whether or not authorized by you. You must notify Stigmi promptly of any unauthorized use of your Account. You may not share, sell, transfer, or otherwise make your Account available to any third party, and you may not access another user's Account without authorization.
Your use of the Service must comply with these Terms and with the Rules, which set out prohibited categories of conduct and Content. In addition, you agree that you will not, and will not attempt to: (a) use the Service for any unlawful purpose or in violation of any applicable law or regulation; (b) interfere with, disrupt, overburden, or impair the integrity or performance of the Service; (c) access, tamper with, or use non-public areas of the Service or its systems without authorization; (d) probe, scan, or test the vulnerability of any system or network, or breach any security or authentication measures; (e) use any automated means, including bots, scrapers, or crawlers, to access, collect data from, or interact with the Service except as expressly permitted by me in writing; (f) create or use unauthorized third-party clients; (g) artificially amplify or suppress information or otherwise manipulate the Service; or (h) encourage or enable any third party to do any of the foregoing.
You retain ownership of any intellectual property rights that you hold in your User Content. Stigmi does not claim ownership of your User Content. However, in order to operate, provide, and improve the Service, you grant Stigmi a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (for example, to format or resize media), publish, publicly display, publicly perform, and distribute your User Content, solely for the purposes of operating and providing the Service. This license continues for so long as your User Content remains on the Service and for a reasonable period afterward to the extent necessary for backups, legal compliance, and the technical operation of the Service.
You represent and warrant that you own or have the necessary rights, licenses, consents, and permissions to your User Content and to grant the license above, and that your User Content and my use of it in accordance with these Terms will not infringe or violate the rights of any third party or any applicable law. You are solely responsible for your User Content and the consequences of posting it.
By default, your profile information and the Content you post are visible to the public, including to people who are not logged in. Certain settings may limit the visibility of some Content to logged-in users or to your followers, but no visibility setting is guaranteed to be absolute. You should not post any Content that you do not want to be publicly accessible. Once Content has been posted, copied, cached, or indexed, Stigmi cannot guarantee its removal from all locations.
If you choose to submit comments, ideas, or suggestions about the Service ("Feedback"), you agree that Stigmi may use that Feedback without restriction and without any obligation to compensate you, and you waive any rights you may have in the Feedback to the extent permitted by law.
The Service, including its software, design, text, graphics, and the "Stigmi" name and branding (excluding User Content), is owned by or licensed to exerinity and is protected by intellectual property laws. Subject to your compliance with these Terms, Stigmi grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use. Except as expressly permitted, you may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from any part of the Service.
The Service may integrate or interoperate with third-party services and content, including GIFs provided through Tenor and bot-protection provided through Google reCAPTCHA, and may contain links to third-party websites. Stigmi does not control and is not responsible for third-party services or content, and your use of them may be subject to separate terms and privacy policies. Your interactions with any third party are solely between you and that third party.
Stigmi may, at the sole discretion and without notice or liability, review, remove, restrict, or refuse any Content, and suspend or terminate any Account, for any reason or no reason, including for conduct that Stigmi believes violates these Terms or the Rules, harms other users or the Service, or exposes Stigmi to legal risk. As described in the Rules, Stigmi reserves the right to remove Content or delete accounts at any time. Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination will survive, including ownership provisions, disclaimers, limitations of liability, and indemnification.
You may stop using the Service at any time. You may delete individual Stigs, export your data, or delete your Account yourself through your account settings. Deleting your Account removes your Content from the Service, subject to reasonable technical delays, backups, and any retention required for legal compliance.
The Service is provided on an "as available" basis. Because Stigmi is built and maintained by a single person, Stigmi does not guarantee that the Service will be uninterrupted, timely, secure, or error-free, and Stigmi may modify, suspend, or discontinue all or any part of the Service at any time, with or without notice. Stigmi is not liable to you or any third party for any such modification, suspension, or discontinuation.
To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless me (exerinity), the operator of Stigmi, from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your Content, your use of the Service, your violation of these Terms or the Rules, or your violation of any rights of a third party.
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of Australia, without regard to its conflict-of-laws principles. You agree to submit to the exclusive jurisdiction of the courts of Australia for the resolution of any dispute, except where prohibited by applicable law. Nothing in this section limits any mandatory consumer-protection rights available to you under the laws of your place of residence.
Stigmi may revise these Terms from time to time. When I do, the "Last updated" date at the top of this page will change. Material changes will take effect when posted, and your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
These Terms, together with the Rules and Privacy Policy, constitute the entire agreement between you and me regarding the Service and supersede any prior agreements. If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Stigmi's failure to enforce any provision is not a waiver of the right to do so later. You may not assign or transfer these Terms without my prior written consent, and any attempt to do so is void; Stigmi may assign these Terms without restriction. Section headings are for convenience only and have no legal effect.
